The Workers Compensation and Injury Management Act 2023 (the Act) is supported by a number of administrative instruments, approved forms and notices, and transitional directives.

The Act and supporting instruments came into operation on 1 July 2024.

Approved forms and instruments must be used from 1 July 2024.

On 20 March 2024 the Workers Compensation and Injury Management Regulations 2024 were made by the Governor and published on the Western Australian Legislation website.

WorkCover WA Recommended Premium Rates 2025/26

WorkCover WA determined the WorkCover WA Recommended Premium Rates 2025/26 announced in a Media Statement from WorkCover WA’s Acting Chief Executive Officer on 4 April 2025.

WorkCover WA’s recommended premium rates for 2025/26 apply to workers compensation policies issued or renewed with a period of insurance commencing from and after 4pm 30 June 2025.

WorkCover WA Industry Classification Order – Second Edition April 2025

WorkCover WA made the WorkCover WA Industry Classification Order– Second Edition April 2025 effective from and after 4pm 30 June 2025.

The WorkCover WA Industry Classification Order provides for the assignment of WorkCover WA premium rating classifications (PRCs) to identify an employer’s industry for the purpose of calculating premiums for workers compensation policies.

Differences between the first and second editions of the WorkCover WA Industry Classification Order are:

  • PRC 72121 – Labour Supply Services Not Elsewhere Classified is otiose and has been removed.
  • PRC 87901 – Employer Receiving Social Assistance Services has been introduced to apply to employers or deemed employers under the Act who are receiving social assistance services (e.g. NDIS participants who directly engage NDIS support workers)
  • PRC 96010 – Private Households Employing Staff is no longer restricted to permanent staff
  • PRC 96011 – Private Households Employing Staff Occasional Staff has been removed
  • Minor editorial changes to some PRCs to better reflect the classification

WorkCover WA made the WorkCover WA Remuneration Guidelines – Second Edition May 2025, effective from and after 4pm 30 June 2025.

The WorkCover WA Remuneration Guidelines second edition is issued under the Regulations and sets out the various payments to workers that are included or excluded in remuneration declarations undertaken by employers when effecting or renewing a workers compensation insurance policy.

Differences between the first and second editions of the WorkCover WA Remuneration Guidelines:

  • A ‘company car’ for private use is included as remuneration with the second edition clarifying the benefit is valued as a fringe benefit.
  • A clearer and more detailed explanation as to when a ‘motor vehicle allowance’ is included as remuneration and how the payment is valued.
  • A clearer explanation that ‘termination payments’ are excluded, but any accrued leave entitlements and payments paid on termination under industrial awards or agreements or underpinned by legal obligations are included as remuneration.
  • Minor editorial changes to clarify the application of the grossed up taxable value for various payments in the Guidelines regarded as a fringe benefit.
  • Correct use of modernised terms including personal leave, status of rostered days off and time off in lieu.

The WorkCover WA Guidelines for the Evaluation of Permanent Impairment must be used by Approved Permanent Impairment Assessors when assessing the degree of an injured worker’s permanent impairment.

The WorkCover WA approval criteria for APIA sets out the criteria that must be satisfied for the approval of a medical practitioner as a permanent impairment assessor.

The Workers Compensation (Medical Services) Fees Order 2024 (No.2) fixes the maximum amount of compensation payable for a medical expense, incurred or to be incurred, for a medical service as a result of a worker’s injury from employment under the Act.

The Workers Compensation (Health Services) Fees Order 2024 (No.2) fixes the maximum amount of compensation payable for a health expense, incurred or to be incurred, for a health service as a result of a worker’s injury from employment under the Act.

The Workers Compensation (Workplace Rehabilitation Services) Fees Order 2024 (No.2) fixes the maximum amount of compensation payable for a workplace rehabilitation expense, incurred or to be incurred, for a workplace rehabilitation service as a result of a worker’s injury from employment under the Act.

The Workers Compensation (Approved Permanent Impairment Assessor) Fees Order 2024 (No.2) fixes scales of fees and charges for permanent impairment assessment services provided by approved permanent impairment assessors under the Act.

On 22 May 2024 the Workers Compensation and Injury Management Conciliation Rules 2024 were made by the Director, Conciliation and prescribe matters necessary or convenient for giving effect to the conciliation functions in the Act.

The conciliation service forms are approved by the Director, Conciliation in accordance with the Workers Compensation and Injury Management Conciliation Rules 2024 and are for use in the conciliation of a dispute.
