Resolve a dispute

If there is a dispute regarding any aspect of your claim, WorkCover WA’s Conciliation and Arbitration Services (CAS) is the legal jurisdiction for resolving or settling workers' compensation-related disputes.

Do I need to be represented?

Representation is not compulsory in conciliation or arbitration. However, if you would like representation you have several options:

Engage a lawyer/solicitor - Legal practitioners work under a fee structure that governs the amount that they can charge for proceedings before WorkCover WA's Conciliation & Arbitration Services.

Engage a Registered Agent - Registered Agents are approved and regulated by WorkCover WA to appear at proceedings before the CAS. The maximum allowable hourly rate charged by Registered Agents is 50% of the hourly rate of a senior legal practitioner. To engage a Registered Agent, see the list of registered agents.

Have a personal supporter - Other than an official representative, you may be supported by a union representative, family member or friend during the dispute resolution process if the conciliation officer or arbitrator allows it.

While my claim is being disputed, how can I access payment for temporary wages and payment of medical expenses?

You can lodge an Application for Conciliation (Form 100) (PDF - 130kb) to help cover you for weekly payments of compensation up to 12 weeks, or up to 5% of the prescribed amount for medical and related expenses you have already paid. A decision to award payment is made by a conciliation officer and is based on evidence that you submit with the form.
