Rules

The Minister for Commerce has now approved the Workers' Compensation and Injury Management Conciliation Rules 2011 and the Workers' Compensation and Injury Management Arbitration Rules 2011.

These Rules will be in effect from 1 December 2011 to support the new arrangements for workers' compensation disputes in Western Australia. The new arrangements consist of separate Conciliation and Arbitration Services.

The Rules were published in the Government Gazette on 9 November 2011.

Costs Determination

In addition, a new costs determination has been published in the Government Gazette, ahead of the 1 December 2011 start date for the new Conciliation and Arbitration Services. The costs determination governs the awarding of legal costs in the Conciliation and Arbitration Services.

The costs determination was made by the Costs Committee (established under s269 of the Workers' Compensation and Injury Management Act 1981) and approved by the Minister for Commerce.
